Terms of Service

1. Who we are and what these terms cover

These Terms of Service ("Terms") are an agreement between you and [COMPANY LEGAL NAME TBD] ("Lifted", "we", "us"), covering your use of the Lifted mobile app, the lifted-ai.com website, and any related services (together, the "Service").

By creating an account or using the Service you accept these Terms. If you do not agree with them, do not use the Service.

2. You must be 18 or older

The Service is intended for adults only. You must be at least 18 years old to create an account or use Lifted. By using the Service you confirm that you are 18 or older.

We do not knowingly collect information from anyone under 18. If we learn that an account belongs to a minor, we will close it and delete the associated data.

3. Lifted is not medical care

If you are experiencing a medical or mental health emergency, contact your local emergency number or one of the resources on our crisis resources page.

4. AI-generated content

• Responses, prompts, summaries, maps and insights in Lifted are generated by artificial intelligence. They are produced automatically, without human review.
• AI output can be inaccurate, incomplete, out of date, or simply wrong about you. Treat it as a prompt for your own reflection, not as fact and not as advice.
• The map Lifted builds is an interpretation of what you wrote. You can inspect, correct and delete anything on it, and you should, when it gets something wrong.
• To generate responses, the content of your conversations is sent to third-party AI providers. We name these providers in our Privacy Policy, and we ask for your consent before your first message is sent.
• You can report AI output you believe is harmful or inappropriate from within the app, or by emailing us.

5. Your account

• You are responsible for keeping your login credentials secure and for activity under your account.
• Provide accurate registration information and keep it current.
• Tell us promptly if you believe your account has been accessed without your permission.
• You may close your account at any time from the app. See the Privacy Policy for what happens to your data.

6. Acceptable use

You agree not to:

• Use the Service for anything unlawful, or to harm, harass, or impersonate anyone.
• Use the Service on behalf of another person, or enter another person's information without their knowledge.
• Attempt to bypass safety measures, rate limits, or access controls, or probe the Service for vulnerabilities without our written permission.
• Scrape, resell, or redistribute the Service or its output as a competing product, or use it to train another model.
• Upload malware, or attempt to disrupt the availability of the Service for others.
• Present Lifted's output to others as professional, medical, or licensed advice.

We may suspend or terminate accounts that violate these rules, and we may remove content that does. Where we can, we will tell you why.

7. Your content and our content

Your content stays yours. You keep ownership of the conversations, reflections and maps you create in Lifted. You grant us a limited licence to store, process and transmit that content strictly for the purpose of operating the Service for you - for example, sending it to an AI provider to generate a response, or storing it so your map persists between sessions.

We do not sell your content, we do not use it for advertising, and we do not use it to train AI models.

Our content stays ours. The Lifted app, website, branding and software are owned by us and protected by intellectual property law. These Terms do not grant you any rights in them beyond using the Service as intended.

8. Price and subscriptions

Lifted is currently free to use. There is no subscription, and we do not collect payment details.

We may introduce paid plans in future. If we do, we will publish the prices and terms before they take effect, any purchase will be optional and clearly presented before you are charged, and billing will be handled by the Apple App Store or Google Play under their own terms - including their refund policies. Reasonable usage limits may apply to free accounts so that the Service stays available to everyone.

9. Availability and changes

The Service is provided on an "as is" and "as available" basis. We do not promise it will be uninterrupted, error-free, or permanently available, and we may change, suspend or discontinue features at any time.

We may update these Terms. If a change is material we will notify you in the app or by email before it takes effect. Continuing to use the Service after that point means you accept the updated Terms.

10. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service or its AI output will be accurate, reliable, or suitable for any particular purpose, including any health-related purpose.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or connected with your use of the Service - including any decision you make or do not make in reliance on AI-generated output.

Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD 100. Because the Service is currently free, this will usually be USD 100.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages and reasonable costs arising from your misuse of the Service or your breach of these Terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination - including sections 3, 7, 10, 11 and 12 - will survive.

14. Governing law and disputes

These Terms are governed by the laws of [GOVERNING LAW TBD - Israel or Delaware, USA], without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the courts of [JURISDICTION TBD], and you and we each consent to that jurisdiction.

If you are a consumer, this does not deprive you of the protection of mandatory consumer laws in your country of residence.

15. General

• If any provision of these Terms is found unenforceable, the rest remain in effect.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these Terms; we may assign them in connection with a merger or sale of assets.
• These Terms, together with the Privacy Policy, are the entire agreement between us regarding the Service.
